Wpływ wad procesu ustawodawczego na założone funkcje prawa finansowego

Celem opracowania było wskazanie wybranych wad procesu legislacyjnego w zakresie tworzenia przepisów prawa finansowego, tj. regulacji odnoszących się do publicznej działalności finansowej, a także próba oceny wpływu tych uchybień na założone funkcje stanowionych unormowań. Ze względu na ograniczone ramy artykułu zakresem badania objęto wyłącznie fazę postępowania prawodawczego w Sejmie. Regional financial development and bank competition: effects on firms' growth

This paper analyses the effect of regional financial development and bank competition on firms' growth using the Spanish provinces as a testing ground. The results show that firms in industries with a greater dependence on external finance grow faster in more financially developed provinces. The results also show that bank monopoly power has an inverted-‘U’ effect on firms' growth, suggesting that market power has its highest effect at intermediate values. Optimal savings and health spending over the life cycle

This paper investigates the relationship between saving and health spending in a two-period overlapping generations economy. Individuals work in the first period of life and live in retirement in old age. Health spending is an activity that increases quality of life and longevity. Empirical evidence shows that both health spending and saving behave as luxury goods but their behaviour differs markedly according to the level of per capita GDP. The share of saving on GDP has a concave shape with respect to per capita GDP, whereas the share of health spending on GDP increases more than proportionally with respect to per capita GDP. Testing explosive bubbles with time-varying volatility: the case of Spanish public debt

In this paper the dynamics of the Spanish public debt-GDP ratio is analysed during the period 1850–2021. We use recent procedures to test for explosive bubbles in the presence under time- varying volatility (Harvey et al., 2016; Harvey et al., 2019, 2020; Kurozumi et al., 2022) in order to test the explosive behavior of Spanish public debt over this long period. We extend previous analysis of Esteve and Prats (2022) where assume constant unconditional volatility in the underlying error process.
Upoważnienie do dokonywania wydatków – problemy definicyjne w zakresie odpowiedzialności za naruszenie dyscypliny finansów publicznych

Jednym z podstawowych naruszeń podlegających odpowiedzialności za naruszenie dyscypliny finansów publicznych jest dokonanie wydatku ze środków publicznych bez upoważnienia albo z przekroczeniem upoważnienia określonego w stosownych aktach planowania finansowego. Ustawa o odpowiedzialności za naruszenie dyscypliny finansów publicznych nie zawiera jednak definicji pojęć, którymi posługuje się ustawodawca przy penalizacji czynów. Odsyła w tym zakresie do określeń w znaczeniu nadanym ustawą o finansach publicznych.
