Hart’s blind spot. The missing piece in The Concept of Law

Al inicio de El Concepto de Derecho, Hart sugiere una asimilación errónea entre conducta que es «no opcional» y conducta que es «obligatoria» (i. e. conducta que o es forzada o sometida a una obligación). In some of his recent work Stanley Paulson puts forward a number of important and ambitious exegetical claims about Hans Kelsen’s Pure Theory of Law. Some of these claims are not novel in Paulson’s rich Kelsenian corpus. But, taken together, these claims now amount to the main outlines of a fully-fledged interpretation of the theoretical foundations of the Pure Theory of Law. Paulson holds that (1) contrary to what Joseph Raz, Carlos S. Nino and many others have claimed, there is, in the Pure Theory of Law, no “justified normativity” thesis. El objeto de este breve texto es poner de relieve alguna duda acerca de un específico, aunque no marginal, aspecto de la compleja teoría de los derechos fundamentales construida por Ferrajoli: el problema del conflicto entre derechos fundamentales. En primer lugar, ofreceré un sumario bastante genérico sobre la presencia (por lo menos aparente, o potencial) de conflictos entre derechos fundamentales en el panorama constitucional contemporáneo. Secondo questa prospettiva, il diritto è il discorso del legislatore e la scienza giuridica non è altro che un discorso sopra un discorso: un meta-linguaggio descrittivo del linguaggio prescrittivo del legislatore.
