Spontaneous Order: Origins, Actual Spontaneity, Diversity

In this paper, we aim to revive the research project on the spontaneous order by examining it critically. We aim to show that normative formulations of the spontaneous order suffer from one main flaw: they focus on the origin of orders rather than on how orders actually perform. In particular, we argue that such normative formulations tend to qualify orders as spontaneous according to two main requirements: unintendedness and negative liberty.

Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. Il primo tema affrontato è quello della par condicio creditorum, che viene esaminata nella sua storia evolutiva dal Code Napoleon, al suo periodo di massima estensione, dato dal codice del 1940, fino al suo ridimensionamento a seguito delle riforme del 2005. It concludes however that a revolution like the aforesaid explained would be only apparently advantageouOld and new problems related to the intervention of creditors in the expropriation (marginal notes at Cass. Sez. Un. January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. Differentiating among pragmatic uses of words through timed sensicality judgments

Pragmatic and cognitive accounts of figurative language posit a difference between metaphor and metonymy in terms of underlying conceptual operations. Recently, other pragmatic uses of words have been accounted for in the Relevance Theory framework, such as approximation, described in terms of conceptual adjustment that varies in degree and direction with respect to the case of metaphor. AbstractThe accuracy of students’ relative comprehension judgments when reading texts is typically rather low. This has been ascribed to students grounding their comprehension judgments on cues that are not diagnostic of their actual comprehension level. Need for closure moderates the break in the message effect

Abstract Cutting the message into smaller portions is a common practice in the media. Typically such messages consist of a headline followed by a story elaboration. In a series of studies Dolinski and Kofta (2001) have shown that such a break in the message increases the effect of the information provided in the headline over that of a story which actually contained information inconsistent with that headline. A possible explanation of this effect, based on the concept of the need for cognitive closure, is presented in the article. The experiment shows the break-in-the-message effect is found mainly for participants with high need for closure but not for those with low such need.

To judge the mutual relationship among elements, pairwise comparisons (PC) are widely used in decision modelling. PC is especially useful when the involved elements are intangible. Frequently, the number of elements to be compared may be very large. When dealing with n elements, the number of PCs is, under the reciprocity hypothesis, n(n − 1)/2. PCs are compiled in so-called pairwise comparison matrices (PCM).
