Del Comune, o un’etica per il XXI secolo?

This article proposes an ethical reinterpretation of Dardot and Laval's analyses of the concept of the "commune", published in 2014. The circulation of ethical arguments and the activation of a line of thought related to public ethics can indeed contribute to finding an answer to some objections moved to the proposal of the commune. This is the intention of my contribution, which focuses in particular on the question of the subjectivity implied, or rather evoked by the theoretical-political proposal of the French thinkers.

The aim of this paper is to study critically, with the help of Habermas´s moral theory, the current naturalistic approach to morality —which is based on both the evolutionary theory and neuroscience—. In doing so it will be explained the specifically moral use of practical reason, as Habermas propose; it will be compared this moral use with Kohlberg's postconventional stage of moral development; and it will be claimed that naturalistic approach cannot explain this stage, that can be understood as specific justice area.

Para la articulación de un concepto de daño moral es necesario analizar los supuestos de reconocimiento legal, la interpretación que los órganos judiciales han hecho y el tratamiento proporcionado en los Principios de derecho contractual europeo y de derecho de daños europeo. Also available from the publisher at: http://dx.doi.org/10.1007/s11217-014-9452-1 The analysis is based on some moral experiences taking place during a terrorist attack on the Norwegian Labor Party’s youth camp on the island of Utøya (outside of Oslo) July 22, 2011, where 69 young people were killed and several seriously injured. After the attack many of the survivors told stories of how strangers spontaneous had helped and cared for each other.
