The Protection of the Weaker Parties in the Platform Economy
2018
Known by many names – platform, sharing, peer-to-peer (p2p), collaborative economy, and so on - entirely new business models have emerged in recent years, whereby online platforms use digital technologies to connect distinct groups of users in order to facilitate transactions for the exchange of assets and services. This dramatic shift in business organisation and market structure has opened an intense debate on the persisting need for those regulatory measures that typically protect the weaker party in bilateral business-to-consumer transactions. Widespread calls for a more “levelled playing field” makes a strong argument for reconsidering the scope of regulation and delegating regulatory …
Peer to Consumer Lending
2022
Peer to consumer lending represents an alternative form of financing characterized, within the crowdfunding genus, by the collecting of credit offers to be matched with borrowing demand through a digital platform. The essay focuses on legal analysis of some aspects of the structure and the functioning of lending marketplaces operating in the sector at stake. The Author argues how this business model – especially when the phenomenon involves consumers and, more generally, non-professionals counterparts – may be critical as regards to the classical cathegories and concepts ruling the lending/borrowing discourse.

2021
The aim of this contribution is to provide a critical review of the case law of ABF on wrapping, a trilateral operation whose purpose is to finance the purchase of a car. After having reconstructed the rationale of the discipline of linked contracts in the Testo Unico Bancario, the contribution criticizes ABF’s rulings that recognize a bilateral link between the wrapping contract and the credit contract, and provides that, due to the breach of the wrapping contract, the concrete purpose pursued by the parties with the purchase contract is impossibile to achieve
Safety assessment of food-contact paper and board using a battery of short-term toxicity tests: European union BIOSAFEPAPER project.
2005
International audience; An European Union (EU)-funded project QLK1-CT-2001-00930 (BIOSAFEPAPER) involves the development, validation and intercalibration of a short-term battery of toxicological tests for the safety assessment of food-contact paper and board. The project involves pre-normative research in order to establish a set of in-vitro cytotoxicity and genotoxicity tests that will be easily adaptable to food-contact fibre-based materials and have endpoints relevant to consume…
Trademarks and Cyberspace
2006
Trademark law aids consumers who use trademarks in the marketplace to identify swiftly and without problems a product they liked or disliked in the past, distinguishing among the different competing manufacturers of a product. No one is entitled to sell or deliver commodities under the appearance that the commodities derive from someone else. The importance of consumer protection cannot be over-emphasized and the average consumer standard should remain the central point of the inquiry, even under domain name litigation. Replacing the initial interest confusion doctrine is one decisive step, along with the introduction of a doctrine representing the fact that there should be no confusion at …
Consumer protection in cases of unfair commercial practices, misleading advertisements, and defective products
2022
Consumer protection has always been an important element in the laws of every country and for good reason, because consumers bring profit, and this improves the economic situation of the country. But the excessive desire to dominate the market led to bad business practices, along with misleading advertisements and defective products. To keep consumers safe and protected, new laws have been formed to protect consumers and their economic well-being. The creation of the directive of uniform legislation for the European Union influenced the fact that national legislation had to be close to uniform requirements, however, weaker consumer protection than in the directive is prohibited. In connecti…
