Author Rights vs Self-Archiving in Spanish Scientific Journals

2013

AbstractThe paper analyzes publishers’ copyright policies and self-archiving conditions of Spanish scientific journals. Data are extracted from the directory DULCINEA that contains information of 1318 Spanish journals, of which 775 (61%) allow some form of self-archiving to be about 60% of the post-print version and allowing them 87% of the deposit of the version of record. In 72% of journals the deposit can be performed immediately after publication and in 16% after article acceptance. 72% of the journals are freely available without charge to the user this figure raises up to 86% if free access after an embargo is considered. Collisional models in a nonperturbative approach

1992

Abstract A nonperturbative method set forth recently for handling quantum dynamics in the intermediate regime (far from either the sudden or the adiabatic limit) is applied to soluble two-state collisional models.

The RedTube copyright infringement affair in Germany: shame on who?

2015

Recently, tens of thousands of German Internet users were confronted with copyright infringement claims for allegedly watching porn clips on the streaming platform RedTube.com. The alleged copyright infringers received ‘Abmahnung’ cease and desist letters that gave them an opportunity to settle copyright infringements out of court by paying rights-holders €250 in compensation. While in cases relating to peer-to-peer file-sharing, the IP address of a peer can easily be identified,1 the RedTube case raises the question how consumers of a stream could be identified. In addition, it raises the question of whether the consumption of a stream is illegal under German law. Assuming that this is not…

Il cloud computing. Alla ricerca del diritto perduto nel web 3.0

2014

Copyright issues on social media

2021

The purpose of the thesis is to determine how social media portals treat their users' copyright, and whether such actions are compliant with the national and EU law. In order to conduct this research, Terms of Service of four popular social media – Facebook, Instagram, TikTok and Twitter, were reviewed. As a result, it was concluded that users are agreeing to license agreements that are concluded between them and social media providers and by doing that, users agree to license all their copyright protected works to the social media providers under non-exclusive licenses. The author concludes that such licensing is not compliant with the national law and therefore Terms of Service copyright …

Salmo salar fish waste oil: Fatty acids composition and antibacterial activity

2020

Background and aims Fish by-products are generally used to produce fishmeal or fertilizers, with fish oil as a by-product. Despite their importance, fish wastes are still poorly explored and characterized and more studies are needed to reveal their potentiality. The goal of the present study was to qualitatively characterize and investigate the antimicrobial effects of the fish oil extracted from Salmo salar waste samples and to evaluate the potential use of these compounds for treating pathogen infections. Methods Salmo salar waste samples were divided in two groups: heads and soft tissues. Fatty acids composition, and in particular the content in saturated (SAFAs), mono-unsaturated (MUFA…

Present Uncertainty and Looking to the Past: The Ambiguous Literary Nationalism of Putnam’s Monthly

2023

Putnam’s Monthly (1853-1857) was one of the best literary and general interest magazines in antebellum America. Besides its high quality, what made the New York-based magazine stand out was its commitment to publishing American writers and focusing on American themes at a time when, with no reliable international copyright protection in place, many periodicals in the United States were in the habit of reprinting the works of foreign (primarily British) authors, sometimes without payment. However, despite its optimistic literary nationalism, Putnam’s Monthly expressed uncertainty about the quality of contemporary American literature and, indeed, about the capacity of American society to enco…

Blockchain and Smart Contracts: New Perspectives on Copyright Protection in the Digital Single Market

2022

New technologies making use of blockchains and smart contracts have been considered an efficient and innovative way to achieve the goal of effective copyright protection in the digital market. It is impossible to deny, however, that these innovative technologies raise serious questions about their compatibility with international, European, and national legislative frameworks, at least if we compare them with the original and most widely-used blockchain model (i.e., the so-called permissionless blockchain). Indeed, permissionless blockchains create a “law-free zone” resistant to any subsequent modification and judicial intervention. In this general context, this chapter aims to analyse the …
