The commemorations of Dante Alighieri ‘s 700th death anniversary saw in 2021 a ‘national’ and even a ‘nationalist ‘ Dante cropping up once again in the Italian public discourse. This article summarises the history of the public and political uses of the poet of the Divina Commedia: from the end of the 18th century, when his modern cult was born, to the Risorgimento, from the First World War to Fascism, up to the more recent ‘pop’ Dante.

In the aftermath of the First World War, a major anticommunist and repressive wave swept across the European continent, following the smashing of attempts to export the Bolshevik revolutionary breath from Russia. In this context, the Communist International founded, at its 4th Congress in 1922, the International Red Aid (IRA), a auxiliary organization specifically charged with helping revolutionary militants who were victims of repression. La lettura di “Legioni e Falangi” consente di acquisire un più ampio spettro della realtà intellettuale degli anni della guerra e di comporre un quadro più articolato delle diverse proposte culturali sorte in seno al fascismo. Uso de símbolos totalitarios: ¿es trasladable a España el modelo alemán? Una crítica a la aplicación del artículo 510 CP

La proliferación del uso de símbolos fascistas en concentraciones públicas ha llevado a proponer su prohibición e incluso su penalización. En esta dirección apunta la STS 675/2020, de 11 diciembre, que aplicó el artículo 510.1 CP por distribuir emblemas nazis. Conviene analizar la adecuación de esta solución a la doctrina del Tribunal Constitucional y del TEDH. Igualmente, resulta de interés atender al Derecho alemán, que se propone como modelo a seguir para tipificar en nuestro país el empleo de tales signos, en particular el § 86 a StGB y la jurisprudencia del Tribunal Constitucional Federal que lo avala.
