Resumen: Los jueces asumen una posición sobre qué cuenta o no como derecho cuando resuelven casos. Parece entonces que deberían recibir una buena formación en teoría del derecho, que precisamente intenta ofrecer una respuesta a esa cuestión. En el trabajo analizo las dificultades relativas a la formación de los jueces en teoría del derecho. En la última parte, sostengo que debe formarse a los jueces en diversas teorías del derecho (plausibles) y que las partes del proceso deberían tener una mayor intervención en relación al derecho aplicable. Spesso funzioni amministrative sono svolte da giudici. La separazione dei poteri è un criterio ordinatore dell’ordinamento costituzionale che, tuttavia, non è osservato nel diritto positivo in modo assoluto. Questa sovrapposizione tra funzioni e poteri può considerarsi fisiologica rispetto ad una realtà ordinamentale complessa.
