Mediation in Spain: Novelties Derived from the Boost of the European Legislator

2015

This paper seeks to analyse the Act 5/2012, of 6 July of mediation in civil and commercial matters, which has resulted in the definite incorporation to the Spanish legal system of Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008. This law intends to enhance the access to mediation as a way of dispute resolution between private parties, which, while it had been already in practice in some Autonomous Communities in certain matters, lacked of a specific normative body to regulate it. The law is certainly limited in regulating certain aspects of mediation, whereas in some other aspects it still raises some concerns. All of these questions are to be examined in t…

2015

Liability for defective products meets a modern legal framework applicable to cases which have an international nature in the European Union. However, the new regulatory developments have not solved the existing coordination problems and offer an unjustified complexity, so there is a certain risk that the objectives pursued by the European legislator in this strategic sector for the EU internal market are not going to be fulfilled. The objective of this study is to analyze the solutions contained in Regulation (EC) 442001, relating to jurisdiction, the recognition and enforcement of judgments in civil and commercial matters and Regulation (EC) 8642007, concerning the law applicable to non-c…

2019

In June 2012, the European Union (EU) disbursed 41.3 billion Euros to the Spanish government to cover the banking liquidity needs. This "rescue" not only involved reforms related to the regulation of the financial sector. They also brought the labor reforms of 2010-2012. Such reforms involved a radical change in the model of Union Law in our country, and were originated in the context of a UE procedure for excessive deficit. Within the framework of this procedure, Spain had to address the reform of the labor relations system. Law 3/2012, of July 6, of urgent measures for the reform of the labor market, complied with the conditions imposed by the European Council to that effect. The internat…

Ciertamente,…

The freedom of conscience and religion of particularly dangerous offenders (Article 88a and 88b of the Executive Penal Code)

2020

Wolność sumienia i religii należy do katalogu podstawowych praw człowieka.
