The purpose of this article is to present the repression that hit Catalonia during the Spanish Civil War (abolition of autonomy and return to centralism, criminal sentences of a political nature), thus showing that prudent political choices, dialogue, and mediation in Catalonia are a matter of utmost importance. Historical experiences should not become an element of political games but motivate a debate between the central government and the autonomous region on reforming the state system and improving cooperation mechanisms. La responsabilidad internacional penal de los individuos se inscribe en el marco de la lucha contra la impunidad de los crímenes más graves y tiene por objeto la persecución y sanción de los criminales que se encuentran a la cabeza de la empresa criminal. Por lo tanto, responde a una serie de principios generales de derecho penal y de derecho internacional que han sido sometidos a una evolución constante por parte de la jurisprudencia internacional. El artículo que se presenta a continuación muestra tal evolución y el estado actual de la discusión en el marco del Estatuto de Roma.

Workers, the self-employed and TRADEs: Conceptualisation and collective rights in Spain

The subjective scope of application of Labour Law is set by the Statute of Labour. Nevertheless, the interpretation of the Courts is crucial to understand who is a worker in Spain. In this study, the criteria set by the Spanish courts and their evolution are analysed. Recently, the Spanish Supreme Court seems to have abandoned the ‘control test’ criteria for classifying workers and has moved towards a personal conceptualisation of work. Undeclared work and legal instruments for combating it in Spain

Abstract: This article analyses the measures adopted in Spain to combat undeclared work, although only with respect to activities included in the scope of the Spanish Workers’ Statute (workers under employment agreements). For the purposes of this analysis, the measures have been broken down into three main groups: control measures; measures to combat illegal employment and, finally, measures to promote legal employment. The essay focuses on the procedural aspects concerning the enactment of the five italian special administrative areas' "statuti" (i.e. Sicilia, Sardegna, Friuli-Venezia Giulia, Trentino-Alto Adige e Valle D'Aosta's supreme regional acts, regulating their constitutional organization).
