This paper considers the problem of administrative capacity as one of the main requirements that the accession countries seeking EU membership had to meet, and as a prerequisite to the decentralization of their public sectors and public finances. The selected decentralization problems are analyzed using the cases of two countries: Romania and Poland. The results of a theoretical and practical evaluation of administrative capacity as a likely obstacle to fiscal decentralization are presented taking account of the different levels of decentralization in Poland and Romania. El propósito de este trabajo es analizar aquellas situaciones en los que los hijos menores se niegan a relacionarse con uno de sus progenitores con el no conviven. Se trata de aquellos casos en lo que no existe justa causa para limitar o suprimir el derecho de visita de los progenitores. Nos proponemos analizar las soluciones que se han aplicado por la jurisprudencia. The aim of this paper is to analyze situations in which younger children refuse to associate with one of their parents with the non-living. Sometimes these are cases where there is no just cause to limit or eliminate the right of access of parents. We intend to analyse the solutions that have been applied by case law.
