2014

The author examines the formula “ut inter bonos bene agier oportet et sine fraudatione” of the actio fiduciae from the point of view of its internal meaning. In particular, on the grounds of the sources of the third and second century B.C. the author argues (confirming the results of his recent research) that the qualification “vir bonus” underlying the words “inter bonos” indicates an ethical-behavioural perspective, not a social status; and proposes a reading’s hypothesis that attaches an autonomous role to the adverb “bene” (generally considered pleonastic respect to the terms “inter bonos”). The author, finally, shows that the sources do not justify the idea that the meaning of the crit…

When a virus (Covid-19) attacks human rights: The situation of asylum seekers in the medico-legal setting

2020

The Covid-19 pandemic is a global health emergency that requires immediate, effective action by governments to protect the health and basic human rights of everyone’s life. Refugees and migrants are potentially at increased risk because they typically live in overcrowded conditions often without access to basic sanitation. Since the beginning of the official lockdown for Covid-19, the medico-legal assessment of physical violence related to obtaining status or other forms of human protection has been frozen.

Ethanol-Induced Oxidative Stress Modifies Inflammation and Angiogenesis Biomarkers in Retinal Pigment Epithelial Cells (ARPE-19): Role of CYP2E1 and …

2020

The retinal pigment epithelium (RPE) plays a key role in retinal health, being essential for the protection against reactive oxygen species (ROS). Nevertheless, excessive oxidative stress can induce RPE dysfunction, promoting visual loss. Our aim is to clarify the possible implication of CYP2E1 in ethanol (EtOH)-induced oxidative stress in RPE alterations. Despite the increase in the levels of ROS, measured by fluorescence probes, the RPE cells exposed to the lowest EtOH concentrations were able to maintain cell survival, measured by the Cell Proliferation Kit II (XTT). However, EtOH-induced oxidative stress modified inflammation and angiogenesis biomarkers, analyzed by proteome array, ELIS…

2019

Shapiro works out a version of legal positivism taking as its starting point Hart’s practice theory of law. Some serious limits of Hart’s practice theory of norms concern the conception of legal obligation and normativity of law. In this paper I analyze the limits of Hart’s conception of legal normativity and I appraise whether the planning theory of law indicates the correct direction for overcoming them. To anticipate the conclusion, my effort is to show that Shapiro replicates Hart’s mistakes on this subject-matters. The paper is divided in three main sections. First, I will present briefly a critical reconstruction of Hart’s conception of normativity, reconstruction which is partially d…
