Do fee-shifting rules affect plaintiffs’ win rates? A theoretical and empirical analysis

Abstract This article studies whether fee-shifting rules can affect plaintiffs’ win rates. Beyond theoretical modeling, this study goes a step further and provides empirical evidence on this issue, thanks to the study of a real change in Spanish legislation. Spain applied the so-called English rule in 2011 in the administrative jurisdiction. This study explores whether plaintiffs were more or less successful when litigating against public administrations since then. After controlling for several other factors, it is shown that the new rule considerably increased plaintiffs’ win rate (while also reducing litigation). What makes environmental performance differ between firms? Empirical evidence from the Spanish tile industry

Environmental performance is a matter of major concern both for policy makers and for firm managers. In this paper we interpret firms' environmental performance as their ability to reduce polluting wastes while maintaining observed levels of inputs and desirable outputs. Making use of data envelopment analysis techniques, we compute waste-specific environmental efficiency measures for a sample of ceramic-tile producers located in the eastern Spanish region of Valencia. Our results show that there exists substantial room for improving environmental performance, which would have highly beneficial consequences for the local environment. This chapter builds on spatial approaches to study everyday life, and in particular to consider Henri Lefebvre’s (1901–1991) theory on the social production of space. Lefebvre’s ideas on the social production of space are based on a dynamic “spatial triad” of conceived (representations of space), perceived (socio-spatial practices), and lived space (representational space). This empirical research explores the perceptions and attitudes of employers in hiring and retaining people with borderline intellectual functioning (BIF). Abstract This article presents the redefined concept of the homescape as space where transnational, newly arrived, and settled families can provide agency for their identity framing through multisensory discourse resources. The study investigated the experiential, non-interactional multisensory discourse resources in the homescape. The homescape extends from the Linguistic Landscape and houses temporal and spatial components, which occur over time. This article presents empirical evidence on the determinants of the financial behavior of small family businesses and their differences from nonfamily small businesses. Taking into account two consolidated financial approaches, (1) the trade-off theory and (2) the pecking order theory, several hypotheses on the financial behavior of both groups of firms have been tested. By estimating these models through panel data methodology, using a sample of Spanish family businesses together with another control group of nonfamily businesses, we have obtained results confirming that a business's family nature does lead it to employ financial policy different from the rest of businesses. This paper disentangles how the modes of ownership distribution among multiple blockholders and their heterogeneity shape principal–principal conflicts and, in turn, affect firm performance. The paper offers empirical evidence from a panel of Italian closely held firms over the period 2009–2014. Research Findings/Insights. We explore the principal–principal conflicts among blockholders across two distinct control structures.
