L’articolo analizza in chiave critica la disciplina nazionale del subappalto nell’ambito delle gare pubbliche, così come recentemente riformata a seguito di diversi interventi normativi in ottemperanza alla procedura d’infrazione avviata dalla Commissione UE. The article critically analyzes the Italian regulation of subcontracting in the context of public tenders as recently amended by several legislative measures in compliance with the infringement procedure launched by the European Commission against Italy. According to the Author’s view the current legislative framework – characterized by the almost overall elimination of the previous limits (probably even going beyond what the European Commission requested) – lacks in finding a fair balance between the principle of the maximum participation in the tender on the one hand and the need to prevent and reveal potential collusive conduct on the other. Furthermore this conclusion is supported by the analysis of the regulation of the causes of exclusion from the tender still too timid in envisaging the optional exclusion of the participants due to anticompetitive conduct.

La regione dei Caraibi abbraccia, infatti, sia alcune delle isole dell’arcipelago delle Piccole Antille (Martinica, Guadalupa), sia l’isola di Haïti, che fa parte delle Grandi Antille, che la Guiana incastonata sulla costa orientale dell’America meridionale. Pur nella diversità dei movimenti ideologici e degli avvenimenti storici che si sono succeduti nella regione, le opere letterarie degli scrittori caraibici francofoni, nel loro insieme, hanno oscillato, e continuano …

The definition "Franco-Caribbean Literature" used by convention from the critique to indicate all the literary production in French of the central region of the American continent is very improper. The Caribbean region includes in fact the islands of Martinique Guadeloupe Haïti and the Guiana. Despite the diversity of ideological movements and historical events that took place in these countries the literary works of the Caribbean writers have fluctuated and continue to oscillate between two tendencies: that of rooting in tradition and that of escape from it. The writers show themselves open to comparison and dialogue with other literary and cultural traditions in order to create a narrative form that corresponds to the many inheritances of those composite populations. Here the cultural syncretism that has been created allows to recognize a common identity in the name of all that the West wanted to extinguish. The common denominator seems to be inverted in the contradictory result of courageous but dangerous encounters of curiosities that can lead to conflicts to exclusions.

Où est-on quand on est en prison ?

Affirmer qu’on peut juger d’une société en visitant ses prisons, c’est affirmer que la pénalité manifeste la nature du lien politique. Ainsi, l’exclusion que réalise l’emprisonnement pratiqué actuellement en France traduit concrètement, par sa passivité et sa quête de neutralité, l’imaginaire du contrat social, attestant que l’abolition de la peine de mort n’a pas encore fait l’objet d’une réception pleine et entière. Incarcérer autrement, incarcérer pour inclure en condamnant non à une durée mais à une mise en action, participerait donc à régénérer la manière dont nous envisageons ce qui nous unit.

Este estudio tiene por objeto identificar la relación existente entre las trayectorias delictivas y los factores de vulnerabilidad y exclusión social en adolescentes en conflicto con la ley. Para ello se analizan 281 expedientes de adolescentes en conflicto con la ley de la ciudad de València y se generan 3 trayectorias delictivas: inicial, moderada y consolidada, que se asocian a indicadores de vulnerabilidad y exclusión social. Exclusión discursiva: el imaginario social sobre inmigración y drogas

El trabajo pretende conocer las estructuras de los discursos sobre inmigración, especialmente de aquellos que también abordan el tema de las drogas. Además se pretende desarrollar un modelo empíricamente fundamentado y teóricamente sólido de exclusión social. Para este estudio, se realizó un análisis de discursos populares en diferentes barrios de ciudades de la Comunitat Valenciana. Además, se analizaron las noticias de diversos periódicos gratuitos de dicha comunidad autónoma.
