L’insostenibile leggerezza dell’incertezza del diritto

The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? Starting from these and similar questions, the paper proposes a reconstruction of the law and of the underlying legal ideology of contemporary constitutional States.

This paper offers a diachronic reconstruction of MacCormick’s theory of law and of legal argumentation; in particular, two connected points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. In this paper I try to revise Sen’s thesis about the «transcendental» nature of Rawls’ theory of justice. According to Sen transcendental theories of justice are unnecessary. What we aim at is to justify a series of comparative judgements about two or more states of affairs.We do not strive, unlike Rawls, to form a complete system of moral principles that backs an «ideal just society». I try to show that Sen’s «comparative» account is weak. First of all, Sen does not offer a fair interpretation of Rawls’ theory. Questo lavoro analizza le valenze paradigmatiche assunte dalla sua figura nella memoria civica siracusana e nella produzione storiografica; inoltre ricostruisce le dinamiche politiche che hanno spinto i principali tiranni siracusani (da Dionisio I a Ierone II) a stabilire un confronto con Gelone. Il testo prende in esame il complesso di materiali editi e inediti (fonti storiche e archivistiche, documenti musicali, testimonianze etnografiche) che attestano la presenza del tarantismo in Sicilia dalla metà del Seicento alla fine dell’Ottocento. Il caso siciliano viene quindi inquadrato nell’ambito dell’ampia letteratura che ruota intorno al fenomeno, a partire dal classico studio di Ernesto De Martino fino al dibattito sull’interpretazione del fenomeno fra i poli dell’esorcismo e della possessione, dovuto soprattutto all’etnomusicologo francese Gilber Rouget. This paper proposes a new edition with commentary of the poem “Be·m plagr’ueymais qu’ab vos, dona, ·m valgues” by Guillem Peire de Cazals and represents a first critical and hermeneutical reassessment of the poetry of the troubadour from Cahors, that has long been neglected. The text presents the classical structure of a love-story (springtime exordium, singing brought on by love, the theme of improvement, courting with no hope of a reward, a request for mercé) and invites the fin aman to be patient. In entrambi i casi la Sicilia è un’isola con un grande vulcano – trasfigurata in un ambiente fantastico o riscritta secondo alcuni stereotipi – che i due autori utilizzano con accezioni diverse nella costituzione dell’ecosistema delle loro narrazioni.
