La selezione dei giudici della Corte di giustizia. Poteri e limiti del comitato ex. art. 255 TFUE
2013
Abstract The appointment of judges to supranational and international courts has long been an unstudied area of sovereign activity. However, the growing role and significance of the European Court of Justice (ECJ), by now one of the most significant players within the European political and constitutional space, demands reforms which also affect its architecture. The creation of the advisory panel under article 255 TFUE, is a way to improve judicial independence and proficiency but also a mean to achieve an adequate level of judicial accountability. Indeed, the existing national nomination processes, missing both transparency and public involvement, risk to shape courts which are far away t…
Approaching the Bench: Teaching Magistrates and Judges how to Work Effectively with Interpreters
2015
Reports about judicial misunderstandings of the interpreting process are common (Berk-Seligson 2008; Morris 2010; Hale 2011a). The misconception that interpreters ‘just translate’ from one language to another by swapping individual words from language A to language B in a mechanical, uncomplicated way, is still prevalent among some legal professionals. Research into court interpreting, however, has highlighted the complexities involved in attempting to achieve a pragmatically accurate rendition in conditions that are usually less than adequate (Hale 2004; Mikkelson 2008; Hale & Stern 2011). In order for court interpreting to be successful, all parties must be aware of its challenges and…

Reprobación y sátira del "gramático" en las letras áureas II. Textos literarios, principios del siglo XVII
2018
In this work, the author studies the satires against the grammarian in Spanish literary texts of the first third of the 17th century, according to the idea of grammar developed by Nebrija and other humanists. Following the negative judgement made by many essay writers in the 16th century, Salas Barbadillo and Quevedo will repeat some specific motives of that criticism, such as the arrogance or the interest in minor features of the texts, compared to the allegedly profound knowledge seeked by theologicians and moral philosophers. By so doing, these authors take part in an intellectual atmosphere against philologists, that confirms the exclusion, in the Spanish thought of the Golden Age, of t…
Avicenna on Negative Judgement
2016
Avicenna’s logical theory of negative judgement can be seen as a systematic development of the insights Aristotle had laid out in the De interpretatione. However, in order to grasp the full extent of his theory one must extend the examination from the logical works to the metaphysical and psychological bases of negative judgement. Avicenna himself often refrains from the explicit treatment of the connections between logic and metaphysics or psychology, or treats them in a rather oblique fashion. Time and again he is satisfied with noting that this or that question is not proper for a logician and should be dealt with in metaphysics or psychology—without bothering to refer his reader to the …
Constructing the Audit Risk Assessment by the Audit Team Leader When Planning: Using Fuzzy Theory
2021
The aim of this study is to construct the assessment of the expected audit risk by the audit team leader (ATL) during the planification phase of the audit. The ATL plays an important role within the audit, and even more so regarding small and medium-sized (SME) audit firms. The audit risk assessment is critical as relying more (less) on internal controls implemented by the client leads to performing less (more) substantive audit procedures. This is determined by the ATL based on their professional judgement and previous experience. The use of fuzzy theory has powerful potential into the audit arena, as the audit risk assessment (outcome) is critically related to the auditors’ judgement and …
