La interpretación jurídica con perspectiva de género : Un decálogo de estándares interpretativos

2021

: The Argentine legal system is part of the constitutional paradigm. In this case, the gender perspective is an essential condition to make a legal correct interpretation because its postulates influence any notion and course of legal action. On this matter, I assume a theoretical foundation of the gender theory and I recommend a decalogue of interpretative standards which receive its vision.

Ricerche in tema di società questuarie

2019

About the regulations of the societas quaestus - referable to the societas universorum quae ex quaestu veniunt and to the societas unius alicuius negotiationis and unius rei - the interpretative efforts of the Roman jurists were given profusely since the end of the republican age. The scientific monograph puts itself on the traces of identifying the notion of quaestus (gain) with particular reference to the inclusion within it of the so-called remuneration gifts. Furthermore it reconstructs the jurisprudential debate that aroses around the question of whether the socii - in the determination of the shares - had to respect a proportion with the contributions and in this sense with an attempt to explain the existing contrast between a passage from the Digest and one of the Iustiniani Institutiones. Moreover always with specific reference to the societas quaestus the monograph investigates the setting-up of the intempestiva renuntiatio supporting its origin out of the contrast between Proculiani and Sabiniani so far postulated in doctrine. Finally the book closes with a chapter dedicated to the genesis of the term egestas which appears in a fragment of Modestinus (D. 17.2.4.1) dedicated to the causes of dissolution of the societas consensu contractaSettore IUS/18 - Diritto Romano E Diritti Dell'Antichita'

Hegel’s Non-Metaphysical Idea of Freedom

2016

the article explores the putatively non-metaphysical – non-voluntarist, and even non-causal – concept of freedom outlined in Hegel’s work and discusses its influential interpretation by robert Pippin as an ‘essentially practical’ concept. I argue that Hegel’s affirmation of freedom must be distinguished from that of Kant and Fichte, since it does not rely on a prior understanding of self-consciousness as an originally teleological relation and it has not the nature of a claim ‘from a practical point of view’.

Physics beyond colliders at CERN: beyond the Standard Model working group report

2019

The Physics Beyond Colliders initiative is an exploratory study aimed at exploiting the full scientific potential of the CERN's accelerator complex and scientific infrastructures through projects complementary to the LHC and other possible future colliders. These projects will target fundamental physics questions in modern particle physics. This document presents the status of the proposals presented in the framework of the Beyond Standard Model physics working group, and explore their physics reach and the impact that CERN could have in the next 10–20 years on the international landscape.

The electronic substituent influence on the thermally allowed electrocyclic interconversion cyclobutene/butadiene. A MNDO study

1984

The effects of donor/acceptor substitution on the conrotatory cyclobutene/butadiene interconversion have not yet been experimentally studied. MNDO Synchronous Transit/MINIMAX calculations for all possible combinations of NH2/NH3 + 3 groups at the fissile single bond reveal very large substituent effects on the opening reactions and reverse cyclisations. Diamino(1b/2b), diammonio-(1c/2c) and amino-ammonio-substitutions (1d/2d) change the activation energy of the reference ring opening reaction (1a →2a) from 49.9 kcal/mol to 34.7, 29.8 and 26.0 kcal/mol, respectively. This rate enhancement parallels the monotone shift of the transition state pathcoordinate towards the cyclobutenes. Relative t…

Euclidean geometry and physical space

2006

It takes a good deal of historical imagination to picture the kinds of debates that accompanied the slow process, which ultimately led to the acceptance of non-Euclidean geometries little more than a century ago. The difficulty stems mainly from our tendency to think of geometry as a branch of pure mathematics rather than as a science with deep empirical roots, the oldest natural science so to speak. For many of us, there is a natural tendency to think of geometry in idealized, Platonic terms. So to gain a sense of how late nineteenth-century authorities debated over the true geometry of physical space, it may help to remember the etymological roots of geometry: “geo” plus “metria” literall…

The Sylos Postulate reconsidered

2016

This chapter makes a textual comparison between the 1957 2nd Italian edition and the 1962 1st American edition of Oligopoly and Technical Progress, showing that Sylos Labini added to the later edition some fresh sections concerning new firms’ entry and incumbents’ reaction which partially contradict Modigliani’s 1958 presentation of the Sylos Postulate. The theoretical differences between Sylos Labini and Modigliani with regard to the assumption of constant output are traced back to their different modelling strategies on how to tackle the issue of external firms’ conjectures in determining the long-run oligopoly equilibrium price.

Paolo Sylos Labini Vindicated

2017

In the first part of our chapter we critically discuss i) Modigliani’s 1958 interpretation of Sylos Labini’s Oligopolio e Progresso Tecnico (1957), ii) the following debate concerning the Sylos Postulate −the assumption according to which “potential entrants behave as though they expected existing firms to adopt the policy most unfavourable to them, namely, the policy of maintaining output while reducing the price (or accepting reductions) to the extent required to enforce such an output policy” − and iii) the incumbent’s choice of productive capacity to install as strategic entry deterrence. In the second part of the chapter we develop a model in which, as in Dixit (1980), there are three …

A theoretical study of carbon-carbon bond formation by a Michael-type addition.

2012

A theoretical study of the Michael-type addition of 1,3-dicarbonyl compounds to α,β-unsaturated carbonyl compounds has been performed in the gas phase by means of the AM1 semiempirical method and by density functional theory (DFT) calculations within the B3LYP and M06-2X hybrid functionals. A molecular model has been selected to mimic the role of a base, which is traditionally used as a catalyst in Michael reactions, an acetate moiety to modulate its basicity, and point charges to imitate the stabilization of the negative charge developed in the substrate during the reaction when taking place in enzymatic environments. Results of the study of six different reactions obtained at the three di…
