La decadenza nel diritto del lavoro tra vicende traslative e fattispecie interpositorie

L’art. 32 della legge n. 183/2010 ha sollevato molteplici questioni applicative legate alla sua infelice formulazione. Il saggio analizza il controverso perimetro applicativo del comma 4, lett. c) e d), inerenti rispettivamente la cessione del contratto di lavoro avvenuta ai sensi dell’art. 2112 c.c. e i casi in cui si chieda la costituzione o l’accertamento di un rapporto di lavoro in capo a un soggetto diverso dal titolare del contratto. L’Autore fornisce le coordinate per una corretta interpretazione, opportunamente restrittiva, delle previsioni decadenziali alla luce del dato letterale e del diritto dell’Unione europea.

L’articolo analizza L’Adamo, ovvero il Mondo creato, poema scientifico-filosofico di Tommaso Campailla (1668-1740), accademico modicano, che partecipò con i suoi esperimenti scientifici e la sua opera letteraria a diffondere la filosofia cartesiana e le nuove mirabili scoperte in ogni campo del sapere. Nel poema Campailla ricorre al motivo tradizionale del viaggio di conoscenza per squadernare al Primo Uomo, Adamo, le straordinarie meraviglie della creazione, tentando una sintesi tra istanze scientifiche e nuove direttrici della poesia settecentesca.

Despite the progress made by scholars, empirically investigating entrepreneurial ecosystems (EEs) remains problematic because of the inherent complexities and nonlinearities of interactions among EE actors. The research to date has shown a tendency to focus on macrolevel ecosystem dynamics while neglecting the microfoundations of EEs. Apathy Towards the Integration of Usability Work: A Case of System Justification

In this article we report from a case study of a software development organization and we study in particular the developers’ and product managers’ attitudes towards integrating usability work into software development. We offer explanations based on system justification theory illuminating what would-be integrators might be up against. The analysis shows how the developers only pay lip service to usability work and how they treat users superficially. It further shows how that leads to stereotyping of usability designers and users in order to preserve status quo, and how internalization of inequality between the developers and usability designers rationalizes the preservation of status quo.…

The present thesis investigates the nature of relationship between the employee stock ownership and the wealth creation, in the framework of the shareholder governance and the stakeholder governance. Results indicate a non linear relation between both the employee stock ownership and the shareholder value creation taking an inversed-U form. In fact, a positive relation associates these variables for low levels of employee stock ownership. Starting from a level of 3%, the relation became negative. Eclecticism is a complex creative trend born as a consequence of both postmodernism and the heterodox treatment of cultural identity borders. This aesthetic path emerges as a compositional model of great communicative power in contemporary creation in the last two decades. Our essay addresses the Symphony V "American" (2003) by Leonardo Balada (1933) as a compositional paradigm. Through this article we demonstrate the importance of including popular sounds and re-signifying materials in the creative conception. A valid model of communication ahead of the challenges of globalization and mass media processes is therefore established hereby.
