The essay deals with waivers and transactions on employees’ rights. According to the consistent judicial overview of art. 2113 of the civil code, waivers and trans actions on rights guaranteed by mandatory rules of law or collective bargaining, only concern renunciations of rights already acquired by the holder, and not still disputed. In particular, art. 2113 of the civil code does not apply if the right can be dismissed by the right holder, as in the case of job retention.

Σκοπός Η παρούσα ποιοτική έρευνα χρησιμοποιεί την αφηγηματική προσέγγιση για τη διερεύνηση της φύσης και του ρόλου της εμπιστοσύνης στα διάφορα στάδια των συγκρούσεων που παρατηρούνται μεταξύ εργαζομένων στο Νοσοκομείο: από τη δημιουργία τους μέχρι την κλιμάκωση και τη μετατροπή τους από «συγκρούσεις έργου» σε «σχεσιακές συγκρούσεις». l contributo ripropone la discussione sull’esegesi della fattispecie disciplinata dall’art. 1 comma 2 del d. lgs. n. 81 del 2015 (nel testo anteriore alla riforma del 2019) trattata dall’autore nei Colloqui Giuridici sul Lavoro del 2015 (a cura) di Antonio Vallebona per il Massimario di Giurisprudenza del Lavoro. This article republishes (after the Italian Supreme Court judgement n.166/2020 on the Foodora Italia case) the contribution to the exegesis of the case brought by art. 1 para­graph 2 of the d. lgs. n. 81 of 2015 (in the text before the 2019 reform) delivered by the author in the 2015's "Colloqui Giuridici sul Lavoro" (edited) by Antonio Vallebona for the "Massimario di Giurisprudenza del Lavoro". The study rejected the thesis that the job organ­ised by the client was an intermediate regulation between the employee and the self-employed ones. Indeed regarding the conditions for its application it showed the need for extensive reading. The conclusion was that the new discipline was (and is) an anti-fraudulent one. It led to a (relative) expansion of the area ofsubordination as a consequence of a reduction in the scope of coordinated self-employed work. A little more than four years after that article the Italian Supreme Court (with the judgement n.166/2020) on the Foodora Italia case addresses for the first time the issue of the hetero-organised work (by art. 1 paragraph 2 of the d. lgs. n. 81 of 2015). The Supreme Court fully adheres to the paper's thesis. So in terms of the "re­medial" function of the standardthe nature of the organisation's specific conditionand eventually reducing the legal frame for coordinated work. The fact that the procedural matter dealt with the riders was (then and now is) utterly irrelevant for the correct interpretation of such a new provision. Giving to riders of the employee status is not an effect of the peculiarit­ies of the work through digital platforms. It is a consequence of the remedial nature of such a case-law.

The purpose of this paper is to show how trust as an organizational value contributes to employee competence utilization in the case of innovation capability. Thus, it is the objective of this paper to analyze the positive impacts, but also potential limits of trust in business management. L’accertamento del trasferimento d’azienda in caso di cambio di appalto nel rito “Fornero”

Con la sentenza n. 2315/2020 la Suprema Corte ha affermato il principio che l’accertamento dell’anzianità di servizio conseguente ad un trasferimento d’azienda può essere affrontato nell’ambito del rito speciale di impugnazione del licenziamento introdotto dalla L. n. 92/2012. Nella decisione in commento la Corte ha altresì modo di dare continuità all’orientamento per cui la fattispecie traslativa si perfeziona anche in presenza di un mero passaggio di personale in forza di obbligo contrattuale o di legge. With judgement n. 2315/2020 the Supreme Court affirmed the principle that the ascertaining of seniority of service of the employee because of a transfer of undertaking can be examined by the judge according to the special rules of law n. 92/2012. The Court does not exclude a transfer of undertaking also in the case it concerns the staff only for a contractual or legal obligation.
